Terms of Service

1. Acceptance of Terms

By accessing or using NeedaCrew ("the Platform"), operated by Talent Digital LLC, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.

2. Description of Service

NeedaCrew is a staffing and collaboration platform connecting film and production crew members with productions seeking to hire them. The Platform facilitates discovery, communication, and booking between crew members and production entities. NeedaCrew does not employ crew members and is not a party to any employment or contractor agreement between users.

3. User Accounts

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must be at least 18 years of age to use the Platform.

We reserve the right to suspend or terminate accounts that violate these terms, provide false information, or engage in fraudulent activity.

4. For Crew Members

Creating a profile, browsing opportunities, and accepting bookings is free. Crew members are responsible for the accuracy of their profiles, portfolios, and stated availability.

Crew members are independent contractors. NeedaCrew does not provide employment, benefits, workers compensation, or insurance. Crew members are responsible for their own taxes and compliance with applicable laws.

5. For Productions

Productions may browse crew profiles, post projects, and message crew for free. There are no subscription fees, posting fees, or upfront charges of any kind.

A Service & Protection amount applies to bookings facilitated through the Platform. This covers secure payment processing, dispute resolution, and platform operations. Productions are responsible for payment to crew members and compliance with all applicable labor and tax laws.

6. Payments and Fees

All amounts are non-refundable unless otherwise stated. Service & Protection amounts are calculated on the gross booking amount and are due at the time of payment. NeedaCrew reserves the right to modify pricing with 30 days written notice to active users.

7. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose
• Misrepresent your identity, qualifications, or experience
• Harass, discriminate against, or threaten other users
• Circumvent the Platform to avoid fees or placement charges
• Scrape, copy, or redistribute Platform data
• Post false, misleading, or fraudulent project listings
• Interfere with the proper operation of the Platform

8. Intellectual Property

All Platform content, design, logos, and branding are the property of Talent Digital LLC. Users retain ownership of their portfolio content, reels, and uploaded materials but grant NeedaCrew a non-exclusive license to display this content on the Platform for the purpose of facilitating bookings.

9. Reviews and Ratings

Users may leave reviews after completed bookings. Reviews must be honest and based on actual experience. NeedaCrew reserves the right to remove reviews that are fraudulent, abusive, or violate these terms. We do not guarantee the accuracy of user-submitted reviews.

10. Limitation of Liability

NeedaCrew is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of the Platform, including but not limited to lost profits, project delays, crew performance, or disputes between users. Our total liability shall not exceed the fees you have paid to NeedaCrew in the twelve months preceding the claim.

11. Dispute Resolution

Any disputes arising from these terms or use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of New York.

12. Privacy

Your use of NeedaCrew is subject to our Privacy Policy. We collect and process personal data necessary to operate the Platform, facilitate bookings, and improve our services. We do not sell your personal information to third parties.

13. Modifications

We may modify these terms at any time. Continued use of the Platform after changes constitutes acceptance. Material changes will be communicated via email to registered users.
